Consent on Collection, Usage & Disclosure of Personal Data
Consent to Data Collection
By submitting your contact details to Learnify via our request form or any mode of communication, you consent to the collection, usage, and disclosure of your personal data in accordance with the Personal Data Protection Act 2012. Your data may be used for the following purposes:
Contacting you via messaging platforms or phone calls regarding your tuition request.
Facilitating administrative processes in the tutor-matching service.
Sharing your details with the assigned tutor upon confirmation of a tuition lesson.
Sending tuition-related marketing messages via email or messaging platforms (e.g., SMS, WhatsApp, Telegram).
Withdrawing Consent
If you wish to withdraw your consent, please email us at [email protected] or WhatsApp us at +65 8852 9790. We will process your request promptly.
Acceptance of Terms and Conditions
By engaging a tutor through Learnify, you agree to the Terms and Conditions outlined here. The engagement is formalized when a Confirmation Note is sent to you via WhatsApp/SMS/Email, or when the first tuition lesson is conducted as per the agreed arrangements.
Payment and Commission
Payment Terms
Learnify’s matching services are free for clients as commission fees are charged to tutors. After two weeks of lessons (or as stated in the Confirmation Note), clients must pay for two weeks of lesson fees to Learnify. Payments can be made via Bank Transfer, PayNow, PayLah, or Cheque. These payments include the commission charged to the tutor.
Tax and Invoicing
All payments to Learnify are subject to prevailing government taxes (9% GST). An official tax invoice will be issued upon confirmation of lessons. GST collected is remitted to the government and is not retained by Learnify.
Subsequent Payments
Subsequent payments can be made directly to the tutors, using a mutually agreed payment method and frequency. These direct payments are not subject to GST. Any additional tuition services, such as teaching additional subjects or siblings, must be disclosed to Learnify and will be subject to a commission charged to the tutor.
Short-Term Assignments
For short-term assignments (four lessons or fewer), the client may agree to bear the commission to increase the likelihood of finding a suitable tutor. This arrangement is non-transferable, even if the number of lessons extends beyond the initial agreement.
Tutor Reassignment or Cancellation
Dissatisfaction with Tutor
If the client is dissatisfied with the tutor within the first four weeks, they may request a replacement after the first lesson. Clients are required to pay for lessons conducted but incur no additional fees. We recommend a one-month commitment period to assess the suitability of the tutor.
Cancellations
For cancellations before completing four weeks of lessons, Learnify will split 50% of the total lesson fees with the tutor. Clients must pay the amount stated in the issued invoice, covering 50% of the total lesson fees. Payment to the tutor can either be made directly by the client or processed through Learnify. Learnify’s portion of fees is subject to prevailing GST.
Tutor-Initiated Cancellations
If the tutor cancels the assignment due to unforeseen circumstances, payment for lessons conducted will generally still apply. Learnify will review such cases individually to determine the appropriate resolution.
Last-Minute Cancellations and Postponement of First Lesson
Clients must inform Learnify or the tutor at least four hours in advance if postponing or canceling the first lesson. Failure to do so will result in a charge of 50% of the first lesson’s fees to cover the tutor’s time and transport costs. This amount will be shared equally between Learnify and the tutor. Exceptional circumstances will be evaluated on a case-by-case basis.
Late Payment Charges
Penalty for Late Payment
Learnify reserves the right to impose late-payment charges for overdue fees exceeding one month. A $50 late-payment fee will be charged for every subsequent two-week period of non-payment. Administrative fees may also apply depending on the resources required to recover the debt.
Example of Late Payment Penalty
If a client owes $150 for lessons completed on January 8th but fails to pay by February 8th, late-payment charges of $50 will be added for each two-week period starting February 9th. By March 9th, the total amount due would be $250 ($150 initial fee + $100 late-payment charges).
Legal Action
Learnify may pursue legal action or file with the Small Claims Tribunal if payment is not received within three months. Late payment charges will continue to accrue until a final court order is issued. All late payment fees are subject to GST.
Tutor Credentials Verification
Clients have the right to request the educational certifications of tutors to verify their qualifications. Learnify will assist in obtaining and forwarding these documents, subject to the tutor’s consent.
While Learnify strives to ensure the credibility of tutors, we cannot be held liable for inaccuracies in the information provided by tutors. Robust vetting systems are in place to minimize such instances. If fraud is suspected, please notify us, and we will assist in reporting the matter to the relevant authorities.
Tuition Rates and Schedules
Clients and tutors may renegotiate tuition schedules and rates after the first lesson, particularly as students progress to higher academic levels.
Location of Tuition
Tuition will take place at the client’s specified location unless otherwise arranged.
Collusion and Fraud
Attempts to bypass commission payments to Learnify are strictly prohibited. Such actions will result in immediate legal action, including police reports and civil claims to recover lost fees.
Commitment to Quality Service
Learnify does not guarantee academic improvement as a result of tutoring services. However, we are committed to providing the most suitable tutor based on the client’s requirements. Clients are responsible for paying for completed lessons, regardless of perceived satisfaction. Feedback is always welcome and appreciated.
Disclaimer
Learnify endeavors to facilitate the best matches between clients and tutors. While we may mediate disputes, we are not liable for the actions of either party. Learnify reserves the right to withhold services or terminate agreements at its discretion.
Amendments to Terms and Conditions
Learnify reserves the right to modify these Terms and Conditions at any time without prior notice.
Privacy Policy
Learnify is committed to safeguarding the privacy of both tutors and clients. This notice explains our privacy practices. By using Learnify’s services, you accept the practices outlined in this policy.
Confidentiality
Learnify does not rent, sell, or share personal information except as necessary to provide the requested services. Personal details such as NRIC numbers, certifications, and contact information will remain confidential, shared only when essential for service delivery.
For Clients
Tuition details (e.g., location, subject, frequency) may be shared with tutors during the matching process. Full contact details will only be disclosed after lesson confirmation.
For Tutors
General profile information (e.g., qualifications, experience) may be shared with clients during the selection process. Personal details such as contact numbers and full names will remain private until lessons are confirmed.
Computer Information
Learnify collects and stores information such as IP addresses and session details to enhance user experience and for research purposes.
Compliance with Legal Requests
Learnify will comply with legal requests for personal data disclosure from authorities or organizations with valid grounds.
